Terms and Conditions

IMPORTANT NOTICE: By registering or placing an order with our Company, you must confirm that you are 18 years old or above. You must ensure that no other person except yourself shall use your login to purchase alcohol products and a person aged 18 or above (identification required) must be present to take delivery, otherwise delivery shall be withdrawn and attempted at another time to be agreed between you and us.

1. Interpretation

1.1) Definition in this terms and conditions, unless the context otherwise requires:

1.1.1)       “Company” and “we” means Yilu’s Wine Co. Ltd.

1.1.2)       “Customer” and “you” means the person or the person acting on behalf of an organisation or a company who orders Goods from the Company.

1.1.3)       “Goods” means all products supplied by the Company.

1.1.4)       “Receiver” means the person who receives orders on behave of the Customers.

1.2)  The headings in these terms and conditions are for convenience only and shall not affect their interpretations. Please read these terms and conditions carefully before using this website. By using this website, the Customers accept and agree to be bound by these terms and conditions.

2. Legal Term

The Company will comply with all applicable Hong Kong legislation governing the sale of goods and will take reasonable steps to ensure the Goods supplied correspond with its description. The Company reserves the right to revise these terms and conditions at any time without prior notice. If any dispute arises, the Company’s decision shall be final. Where these terms and conditions are available in other languages, the English version prevails.

3. General Sales Term

3.1)  Any person under the age of 18 years drinking any intoxicating liquor on any not licensed premises is illegal.  The Company requires Customers to be aged 18 years old or above to purchase alcoholic Goods.  By placing orders on this website, the Customers confirm the aforesaid age requirement of purchasing alcoholic Goods is fulfilled.

3.2)  All orders of Goods are subject to the Company’s acceptance at its discretion and stock availability. The list of Goods on this website is not an offer but for reference only.

3.3)  The Company shall reasonably maintain up-to-date prices, details and sizes of products on this website for Customers’ reference. Prices are subject to change without prior notice.

3.4)  The Company shall reasonably maintain products displayed on the website are in stock. If from time to time ordered Goods become unavailable, the Company will make suggestions of alternative Goods of similar value and style to the Customers.

3.5)  All orders are subject to confirmation of final availability. The Company reserves the right to reject any orders if the Goods requested are unavailable. In the event that the Company is unable to supply any of the Goods in the Customers’ orders, the Company will notify the Customers by phone or email within 4 working days.

3.6)  No further discount applies to the Goods on sales promotion unless otherwise mentioned.

3.7)  All photos on this website are for reference only and the actual appearance of the Goods may differ from the photos.

4. Registration

4.1)  For settling payment online, Customers must register before placing any order on this website. In the registration process:

4.1.1)       information provided by the Customers to the Company must be accurate, complete and up to date; and

4.1.2)       to avoid illegal and harmful activities, such as underage transactions, username and password must be strictly safeguarded by the Customers; and

4.1.3)       anyone using this website with a Customer’s username and password will be deemed to be that Customer or the person who acts on behave of that Customer.

4.2)  Customers must inform the Company immediately of any changes to the information provided during registration for our better communication and delivery arrangement.

4.3)  The Company has the absolute discretion to refuse or terminate any registrations of Customers for reasons including but not limited to the benefit of the Customers or the Company.

5. Payment Term

5.1)  The Company accept payment by Credit Card (VISA, MasterCard and American Express), Apple Pay.

5.2)  All prices listed are in HK dollars.

5.3)  To keep all our Customers shopping safely, the Company uses secure servers when you place orders. All credit card information is transmitted via Secure Socket Layer (SSL) technology which encrypts your personal information, including credit card number, name and address.  In this way, the personal data would not be read as the information travels over the Internet. To check SSL Certificate information, you may right click the mouse and choose “Properties” and then “Certificates” in Internet Explore and check the “padlock” icon on the left of the address bar in Chrome.

5.4)  For security reason, the upper limit of purchase on this website is HK$10,000 per transaction. Please call our customer service hotline / Whatsapp 9764 2209 or email us at [email protected] for any purchase over the aforementioned amount.

5.5)  When Customers confirm orders on this website, it is equivalent to make offers to purchase to the Company.  Such offers shall be accepted subject to the Company’s sole discretion and may not be accepted due to out of stock.

6. Delivery

6.1)  Customers or Receivers must be aged 18 or above in order to receive alcoholic Goods, otherwise, the delivery of alcoholic Goods would be withdrawn and attempted at another time agreed at the Customers’ cost if applicable.

6.2)  The Company offers free delivery to a single location for purchasing over HK$800 for “Best Value Items” OR HK$1,800 for “Other Items”.  Mixed items of “Best Value Items” and “Other Items” are not available.  Otherwise, a delivery fee of HK$250 will be charged to cover the labour cost per order.

6.3)  Upon confirmation of orders by WhatsApp , the Goods will be delivered to the delivery address at the agreed time period, normally in 3 working days if confirmation of orders at or before 12:00pm from Monday to Friday. 6.4)  We offer next day delivery for purchases over HK$3,000 where orders shall be confirmed by WhatsApp between 9:00am and 12:00pm from Monday to Friday. Orders confirmed on Saturdays, Sundays or public holidays will be delivered on the day following the next working day (for same day delivery arrangements, please call our customer service hotline / Whatsapp 9764 2209 or email us at [email protected] for assistance).

6.5)  The delivery service is available from Monday to Saturday between 10:00am and 8:00pm except public holidays (for special arrangements, please call our customer service hotline / Whatsapp 9764 2209 or email us at [email protected] for assistance).

6.6)  No delivery service is available:

6.6.1)       to certain locations including outlying islands, restricted and rural areas, hotel rooms, ports or ships; and

6.6.2)       to places without legal unloading area within 40 meters of the delivery addresses; and

6.6.3)       to addresses without lift service if the Goods to be delivered contain 24 bottles or above; and

6.6.4)       when typhoon signal No.8 or above or a black rain warning is hoisted or going to be hoisted.

6.7)  The Company reserves the right to charge an additional delivery cost if Customers or Receivers are unable to accept delivery above at the nominated delivery time.

6.8)  Customers shall notify the Company, at least 5 working days prior to the scheduled delivery of Goods, of any change in delivery addresses.

6.9)  In order to comply with the legislation of Plastic Shopping Bag Charging, any plastic bag requested by Customers in the delivery will be charged HK$0.5 each.

7. Non-pickup / Non-delivery

7.1)  The Company will charge storage fees for storing Goods, at a daily rate of 1% of the price of the Goods (minimum daily rate HK$5 per Goods), in the event that:

7.1.1)       the Customers refuse to receive the Goods within 2 weeks upon confirmation of orders by the Company, or

7.1.2)       the Customers fail to receive the Goods after 2 attempts of delivery; or

7.1.3)       the Customers fail to provide the delivery address within 2 weeks upon confirmation of orders by the Company; or

7.1.4)       within 2 weeks, the Customers fail to reply to the Company regarding the delivery arrangement of the confirmed orders or the Company is unable to contact the Customers according to the contact information provided by the Customers.

7.2)  If ordered Goods have not been collected or delivered due to the conditions stipulated in this paragraph and the storage fees with respect to those Goods have not been paid for 3 months from the date of confirmation of orders, the Company has the right to dispose of those Goods with no further notice to the Customers. The Company shall have no liability to the Customers regarding the disposal of those Goods in such circumstances but the Company will remain the rights to claim the Customers regarding any unpaid price and fees incurred from the confirmed orders.

8. Receipt of Goods

8.1)  Title of Goods will be passed to Customers only upon full settlement of payment.  The Customers will take full duty of care of the Goods upon receipt of it.

8.2)  Upon receiving the Goods, it is the responsibility of the Customers or Receivers to examine the condition of the Goods. The Goods are deemed to be accepted by the Customers if no complaints are lodged to the Company at the time of receiving the Goods.

8.3)  Any complaints of the Goods must be lodged by the Customers to our customer service hotline / Whatsapp 9764 2209 or email us at [email protected] at the time of receiving the Goods, otherwise no refunds or returns will be entertained thereafter.

9. Return and Refund Policy

9.1)  The Company will fully responsible for all valid claims of return of Goods with respect to the price of purchase but not for any other claims whatsoever. Refunds are guaranteed on all valid claims of drinks which are below HK$500 (per item).

9.2)  Return or exchange is only available if:

9.2.1)       the condition of the Goods is faulty or the Goods are not the same as its description upon delivery; and

9.2.2)       the Customers lodges a complaint to our customer service hotline / Whatsapp 9764 2209 or email us at [email protected] immediately upon receiving the Goods, and

9.2.3)       the Customers provides a valid original receipt and proof of purchase of the Goods, and

9.2.4)       the Goods are returned to the Company in exactly the same condition as they were supplied.  If the Goods are not returned to the delivery agent before returning to the Company, the alcoholic Goods shall be kept by the Customers  in appropriate environment including suitable temperature 13-16°C (55-60° F) and humidity level 70-75% and kept away from vibration and sunlight.

9.3)  No returns or refunds shall be made on Goods after the title of Goods have been passed to the Customers.

10. Force Majeure

The Company shall not be liable for the Customers’ damages or loss caused by circumstances beyond the Company’s control such as acts of God, fire, flood, accident, riot, war, government intervention, embargoes, strikes, labour difficulties, equipment failures, or any other causes.
